By downloading or using Desta ("the app"), operated by Dinz ("we", "us"), you agree to these Terms. If you do not agree, do not use the app. Apple's standard Licensed Application End User License Agreement also applies to apps downloaded from the App Store unless replaced here.
You must be at least 13 years old (or the age of digital consent in your country) to use Desta. If you are under the age of majority, you may use the app only with the involvement of a parent or guardian.
We grant you a personal, non-exclusive, non-transferable, revocable license to use Desta for your own non-commercial use, subject to these Terms and the App Store terms.
Desta provides weather, wind, wave, and tide forecasts and estimates for planning and information only. Conditions at sea can change rapidly and can differ from any forecast. Do not rely on Desta for navigation or safety-of-life decisions. Always consult official sources — your national meteorological and hydrographic services (in Croatia, DHMZ and HHI), up-to-date nautical charts, and Notices to Mariners — and use your own seamanship. Tide predictions are estimates unless a port-referenced source is shown. The Boating Window is a general guide, not a go/no-go authority. You are solely responsible for the safety of your vessel and crew.
Forecasts and data are provided "as is" and "as available," sourced from third parties including Apple WeatherKit, Open-Meteo, and WorldTides. Weather, tide, and sea-state information are predictions — we do not warrant that any information is accurate, complete, timely, or fit for a particular purpose, and we do not guarantee that conditions will occur as forecast or depicted.
You agree not to misuse the app, interfere with its operation, attempt to access it in unauthorized ways, reverse-engineer it except as permitted by law, or use it in violation of applicable law.
The app relies on third-party data and services, whose terms may also apply to your use of that data. We do not endorse and are not responsible for third-party content.
The app, its design, branding ("Desta"), and content are owned by us or our licensors and are protected by law. These Terms grant you no ownership rights. If you send us feedback or suggestions, you grant us a non-exclusive, royalty-free license to use them to improve the app.
If Desta offers auto-renewing subscriptions in the future, they are billed through your Apple ID; a subscription renews automatically unless cancelled at least 24 hours before the end of the current period; you can manage or cancel in your App Store account settings. Full pricing and terms are shown at the point of purchase.
We may add, change, suspend, or discontinue any part of the app or its data sources at any time, with or without notice.
To the maximum extent permitted by law, we disclaim all warranties and shall not be liable for any indirect, incidental, special, or consequential damages, or any loss arising from your reliance on the app or its data, including any decision to go to sea. Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence where such limitation is prohibited.
To the extent permitted by law, you agree to hold us harmless from claims and expenses arising out of your misuse of the app or your violation of these Terms or applicable law.
We may suspend or terminate access if you breach these Terms. You may stop using the app at any time by deleting it.
These Terms are governed by the laws of Croatia and applicable EU law, without regard to conflict-of-law rules. Mandatory consumer-protection rights in your country of residence still apply.
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the applicable App Store terms and EULA, are the entire agreement between you and us regarding the app.
We may update these Terms; continued use after changes means you accept them.
